Reportable & Non Reportable Judgements

Reportable & Non Reportable Judgements

1. Whether a judgement is reportable or non reportable is to be determined by the judge concerned on the basis of public utility of the decision and also the peculiarities of the decision.

2. Litigant has no right to get the judgement reportable and non reportable

3. For getting the copies of unreported judgments, you have to file a third party affidavit and get these copies from the court.

Reportable judgments are allowed by the Court to be published in media  & by official magazines like SCC or AIR. These reported judgments can be called as Citations and shall be used in the lower court as reference.

Non-reportable judgments :-

Unreported judgment means, all the other which are not reported. If you want to refer this judgment to the lower court, you ought to produce the certified copy.

In the case of Dharamraj Bhanushankar Dave v. State of Gujarat, 2015 SCC OnLine Guj 2019, decided on 19-01-2017

It was clarified by the Court that reportable or non-reportable is the classification made for the reporting of a judgment in law-reporter and not its publication anywhere else while taking into consideration the important fact that High Court was a court of record.

Hope this clarify, If you still have any doubt, write us in comment section.
